Cartier awarded 500,000 yuan in trade-mark dispute

  Shanghai No.1 Intermediate Court entered a first-instance judgment on Cartier's allega-tion of Foshan Mingkun Ceramic Company, Jinsi Yuma Decoration Materials Co., Ltd and a Shanghai distributor surname Li's infringe-ment of its Cartier and 卡地亚 re-cently, ordering the three defendants to cease infringement and jointly indemnify 500,000 yuan in damages to the France-based jeweler.

  After discovering the three de-fendants used its registered trade-marks Cartier and 卡地亚 on their ceramic products, the court held that though the ceramic products distributed by defendants did not share the same class with the regis-tered trademarks in question, the mark 卡地亚 was already deter-mined as well-know mark and should be protected beyond the orig-inal class.The decision was made accordingly.(By Wu Wenting)
